These are the legal terms and conditions on which we sell any of the products supplied by Stubborn Mule Brewery Limited.

The following terms and conditions apply when placing an order with Stubborn Mule Brewery Limited. Please read carefully. If you have placed an order with Stubborn Mule Brewery you are deemed to have agreed to the following terms and conditions.


About Us

We operate Stubborn Mule Brewery & www.stubbornmulebrewery.com. We are Stubborn Mule Brewery Limited, a company registered in England and Wales under company number 16163174 and with our registered office at Unit 1, Skelton Road, Timperley, Altrincham, WA14 1SJ. Our VAT number is GB 245 0367 21. Our AWRS Reg No is XKAW00000107616.

Our Beers

We’re all about looking for the best ways to present our beers whether they be cask, mini-keg, bottle or can. All of our beers (including mini-kegs, bottles and cans) are naturally conditioned using the yeast that still resides in the beer post-fermentation. None of our beers contain isinglass finings (gelatine obtained from the gall bladder of the sturgoen fish) and which makes the majority (for example our Cream Ale & Magnum Red IPA contain honey) of them vegan friendly.

Our beers do contain allergens including: Gluten, Wheat, Barley, Oats.

We’re doing everything we can to produce tasty, fresh, well presented, modern beers and as a consequence we do experiment brew to brew. We appreciate that consistency is generally desirable in brewing but we also want to continually improve our offering and thus will make changes even to core beers from time to time. This flexibility and license to continually evolve our products, and take a few risks, is what makes brewing at our scale so interesting and is essentially what’s driving today’s thriving craft beer scene.

We’ve built a brewery that’s basic but is starting to produce some great beers. Our current brewing process dictates that all of our beers have undergone secondary fermentation at the brewery and so don’t require a conditioning period following delivery.

Our beers should be well conditioned.


Casks

Our cask beer can be expected to settle in between 24-72 hours following delivery, all our beers have a naturally occurring haze which we quite like. If served inside these recommended times, the haze maybe more apparent although the beer tastes just as good.

As part of our Party Keg services we provide cask taps to serve rather than hand pulls reducing both expense and complexity of set-up.

We will require confirmation pre-delivery you have a suitable place to receive, stillage and serve our cask beers. OUR BEERS WILL NOT BE LEFT TO BE CONSUMED IN PLACES WE DEEM UNSUITABLE.

As far as possible a suitable place will be approx. 12oC-14oC or cellar cool and out of the sunlight.

If a cask is moved following set-up and stillage. It is done entirely at your own risk. We will accepts no returns or refund requests in relation to cask that haven’t settled or served as anticipated.

For Non-Trade sales order casks at a minimum of 2 weeks prior to your event. Delivery will be arranged to allow casks to be tapped and vented 48-72 hours prior to service.

No ullages will be accepted.

KeyKegs

KeyKegs are based on a “bag in ball” principle, have their own specific couplers (check you have one) and – as gas/air never comes into contact with the beer – stay fresh for an extended period of time (weeks rather than days). Our KeyKeg conditioned beers have been primed with corn sugar (dextrose) to achieve higher natural volumes of CO2 in the kegs than we expect in our cask beers. KeyKeg beers can be expected to be ready for service from their service position after 24 hours in your cold room.

Bottles/Cans

Bottles and cans are sold individually depending on availability. These beers are not filtered or sterilised, they are naturally conditioned and packaged onsite in our brewery. Bottled/can conditioned beer invariably will have a fine yeast layer at the bottom of the bottle.

5L Mini-Kegs (approx. 8.5 pints)

Like our other lines of packaging, 5L Mini-Kegs are conditioned in the vessel, they are also primed to increase the levels of carbonation. We believe this enhances beer quality, longevity in service and your overall enjoyment – although it can sometimes lead to a lively first half pint or so.


General

By placing an order with Stubborn Mule Brewery, you are deemed to have accepted these Terms and Conditions of sale.

You must be aged 18 or over to purchase alcoholic beverages. It is an offence to sell alcohol to anyone under the age of 18 in the UK and Challenge 25 is operated where appicable across our business.

We opearte using Challenge 25 and this will be applied to all deliveries of alcohol by our drivers. Deliveries must be signed for by a person of 18 years or older. We will check this by examining either a passport, photographic driving licence or PASS approved proof of age card. If our couriers are in any doubt about the age of the recipient on delivery we reserve the right to cancel the delivery and order itself if necessary.

When ordering and making a payment you are required to accept our Terms and Conditions inclusive of confirmation that you are aged 18 or over.

If your order is a gift and contains alcohol, the recipient must also be aged 18 years or older.

All prices are quoted in pounds sterling.

We aim to ensure the prices and availability shown on our online store, sales and marketing material are accurate. In the event that an error does occur, we will make every effort to contact you to confirm if you would like to proceed with an effected order at the correct price or by substituting for something else if availability is an issue.

Whilst every effort is made to supply all items listed on the online store or via our marketing information, there are instances where this may not be possible.

In the unlikely event that the prices are incorrect and we discover this before shipping your order, we are not required to sell the goods to you at the price shown. We always try and ensure that the prices of goods shown on our website and marketing material are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.

We reserve the right to withdraw or replace products in our online and physical stores without notice.

Merchandise prices and specifications are also subject to change without notice.

We make every effort to ensure that the information on our website and within any marketing or information material is correct. However, Stubborn Mule Brewery takes no responsibility and shall not be held liable for information that is incomplete, inaccurate or out of date.

Stubborn Mule Brewery will not be held responsible for any loss, consequential loss or damage to any individual or business which may have occurred from the use (or misuse) of any product or any information contained on this website.

We cannot accept responsibility for delivery failure if you provide an incorrect address and postal code or incorrect contact telephone number. Please check this information is when placing your order and on confirmation of your completed order.

Stubborn Mule Brewery reserves the right to amend these Terms and Conditions without notice at any time. Your continued use of this site and the Online Store after changes are posted will constitute your acceptance of the changes to these Terms.

The Terms and Conditions on the Stubborn Mule Brewery website supersede all others.


Products & Prices

Webshop prices are VAT Inclusive.

All trade prices quoted exclude VAT.

VAT receipts can be requested by customers who can reclaim VAT.

All products are offered subject to availability.

Prices for our Products may vary from time to time and shall be the price set out in the Order, or, if no price is quoted, the price set out in our price list in force as at the date of delivery. We may, by giving notice to you at any time before delivery, increase the price of the Products to reflect any increase in the cost of the Products that is due to: any factor beyond our control (including foreign exchange fluctuations, increases in taxes and duties, and increases in labour, materials and other manufacturing costs); any request by you, to change the delivery date(s), quantities or types of Products ordered; or any delay caused by any of your instructions or failure by you to give to us adequate or accurate information or instructions.

The quoted price of a Product excludes VAT at the applicable current rate chargeable in the UK for the time being. However, the invoice for Products will include VAT at the current rate where applicable. If the rate of VAT changes between the date of your Order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.


Payment

We shall invoice you for each order prior to the point of delivery.

Unless agreed otherwise, goods will not be delivered until payment in full has been received in the form of Bank Transfer (BAC) or via a debit or credit card payment through our website or over the phone.

If Cash on Delivery has been agreed, goods will not be released at point of delivery until full payment has been received.

Cheques are not legal tender and will not be accepted.

Payment terms and credit periods (if any) should be pre-agreed.

For Customers that have been approved with a credit account, the Customer shall pay the invoice in full and in cleared funds within the pre-agreed credit period. Payment shall be made to the bank account nominated in writing by Stubborn Mule Brewery. Time of payment is of the essence. For all other Orders payment shall be made in via BAC , cash or by card when the order is submitted or upon delivery.

If any alternative payment terms are required by the Customer these must be agreed by Stubborn Mule Brewery in writing prior to the Customer submitting the Order.

We may suspend further deliveries under this contract (without notice) if you become unable to pay your debts as they fall due.

Without prejudice to any other right under law, if you fail to make any payment due to us by the due date for payment, you shall pay to us all costs and expenses incurred by us in recovering such overdue amounts, including without limitation, the fees of any debt collection agencies instructed, any court fees and any legal costs.

If you dispute any invoice you shall immediately notify us in writing. All parties shall negotiate in good faith to attempt to resolve the dispute promptly.


Retention of Title

All goods remain the property of Stubborn Mule Brewery Limited until paid in full. In the event of sale of the goods by the customer prior to payment, the customer shall hold the proceeds of the sale on behalf of Stubborn Mule Brewery Limited in such a way as to be identifiable as the property of Stubborn Mule Brewery Limited.

Where it is not possible to identify the specific goods then we reserve the right to claim for all monies outstanding.

Without prejudice to any other right under law, if you fail to make any payment due to us by the due date for payment, you shall pay to us all costs and expenses incurred by us in recovering such overdue amounts, including without limitation, the fees of any debt collection agencies instructed, any court fees and any legal costs.


Payment Systems

When taking payments via debit/credit card we use iZettle for or over-the-counter and face-to-face transactions in the brewery and Stripe Inc for any website and over the phone payments.

Card payments are made through a secure server, via Stripe Inc & iZettle.

Stubborn Mule Brewery does not store our customer’s financial details when using these systems.

Your payment will appear as ‘STUBBORN MULE BREWERY’ or ‘STUBBORN MULE BREWERY LTD’ on your bank/credit card statement.

Payment will be taken at the time of ordering. We can hold deposit payments at pending if made by debit or credit card.


Direct Debit

We process our direct debit facility via GoCardless. If you have any questions in relation to their owned systems and data storage please contact us and we will liaise with GoCardless.


Personal Payment Data

Stubborn Mule Brewery does not retain and hold your personal information. As such we do not, will not and never plan to pass on of your personal information to third parties.

Our payment service providers (iZettle & Stripe Inc) have each have their own personal data management provisions in place.

iZettle

When buying something from a seller who uses iZettle, you can choose to have a receipt sent to you via email or text message.

If you provide your email address or mobile number, iZettle will remember your details for the next time you buy something from a seller using iZettle, using the same payment card. This is regardless of whether you’ve previously bought something from this seller or not.

This means that your email address or mobile number will be pre-filled in the receipt view for your convenience the next time you buy something from a seller who uses iZettle.

iZettle AB, reg. no. 556806-0734, is responsible for this processing of personal data and will only use your email address or mobile number to send receipts to you. iZettle will not use your contact details for any other purpose, and will not share them with anyone else, without obtaining your consent first.

If you want iZettle to rectify, update or remove your contact details, please get in touch with them at help.uk@izettle.com.

In order to control that iZettle process up-to-date and accurate personal data, you have the right to, free of charge and once per year, obtain an excerpt of the personal data that they process about you. Such request must be undersigned by you personally and sent by regular mail to the following address:

Stripe Inc.

Stripe acts an agent in relation to the Personal Data that you provide or make available to Stripe via Webshop. Stripe usually will not have a relationship with you. In this case, Stubborn Mule Brewery Limited is responsible for ensuring that Customers are provided with appropriate notice and choice with respect to their Personal Data.

If you are a Customer of Stubborn Mule Brewery and have any concerns, questions or would like access or limit the use or disclosure of your Personal Data please contact us directly at tapandshop@stubbornmulebrewery.com. Stubborn Mule Brewery will then work with Stripe Inc to resolve you query on receipt of the request.


Courier Delivery (Retail/Webshop)

Delivery of webshop purchases is normally within 3-5 working days.

We will use our best endeavours to deliver your order promptly but cannot accept any liability for a delay, howsoever caused. We do not deliver on Saturdays, Sundays or public holidays unless by prior arrangement. This service will incur additional charges.

Courier Charges
Our maximum shipping charge is currently £7.20

Small items will be priced below this rate and some items are priced to include shipping (see can tubes) please refer to the price at the Cart.

You can expect to receive your goods via courier delivery with 72 hours from the day of order. Normal courier delivery hours are Monday to Friday 08.00 to 21.00.

We will not refund postage on products returned to Stubborn Mule Brewery unless agreed otherwise.

We do not deliver on Saturdays, Sundays or public holidays unless by prior arrangement. This service will incur additional charges.

Please ensure someone over 18 is available during the delivery window collect and sign for goods.

Deliveries must be signed for by a person of 18 years or older. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. We reserve the right to cancel the delivery if the age and identity of the recipient is in doubt.

It is your responsibility to ensure that an adult over the age of 18 is at the delivery address to sign for receipt of the goods. If delivery cannot be completed you may be liable for any additional courier costs to allow completion.

No refund will be considered for orders made by minors.

It is your responsibility to ensure that an adult over the age of 18 is at the delivery address to sign for receipt of the goods. The re-delivery process can be undertaken twice only, after which couriers are instructed to return the goods to us. In these circumstances you may be liable for any additional courier costs.

Signature at the point of delivery acknowledges receipt of the goods.

Goods will not be left with third parties unless by prior arrangement.

No compensation can be offered for loss of wages due to failed or late deliveries.

Customers accept responsibility for the safe storage and use of the products upon receipt. Stubborn Mule Brewery are not liable for damage caused by customer mishandling.

Please note that deliveries during festive periods may take longer due to additional strains on courier companies.


Delivery & Shipping

Non Courier (Brewery Delivery)

We will use our best endeavours to deliver your order promptly but cannot accept any liability for a delay, however caused. We do not deliver on Saturdays, Sundays or public holidays unless by prior arrangement.

Normal delivery hours can be between Monday to Friday 08.00 to 18.00.

Deliveries must be signed for by a person of 18 years or older.

Signature at the point of delivery acknowledges receipt of the goods. Goods will not be left with third parties unless by prior arrangement.


Lost Casks

We purchase and hire purchase quality steel firkins and pins, they are our property and represent investment in our business. We endeavour to keep these in good condition inside and out to ensure we’re delivering top quality beer. As part of our contract of sale:

WE EXPECT OUR CUSTOMERS TO MANAGE THE CASK(S) WE DELIVER SO WE CAN COLLECT THEM UNINHIBITED ONCE THEY HAVE BEEN USED. IF YOU CALL US ONCE YOU HAVE EMPTIES READY FOR COLLECTION WE WILL ARRANGE A REASONABLE COLLECTION DATE AND TIME WITH YOU.

OUR CASKS SHOULD NOT BE COLLECTED BY ANY OTHER ORGANISATION THAN STUBBORN MULE BREWERY LTD UNLESS WE HAVE ARRANGED THIS.

IF FOR SOME REASON OUR CASKS ARE NOT AVAILABLE FOR COLLECTION AT YOUR PREMISES YOU WILL TAKE ALL NECESSARY ACTION TO HAVE THEM MADE READY FOR COLLECTION OTHERWISE A STANDARD CHARGE OF £90 + VAT WILL BE APPLIED TO YOUR ACCOUNT.


Direct Trade KeyKeg Delivery Service

We offer a trade-only UK-wide next day courier delivery service via DHL.

Beers prices & availability can be obtained by signing up to our online form on the Trade page of our website or by contacting sales@stubbornmulebrewery.com .

Orders and deliveries are managed via sales@stubbornmulebrewery.com

All orders are on a proforma basis unless agreed otherwise. Payment terms and credit periods (if any) should be pre-agreed.

We shall invoice you for each order prior to the point of delivery.

We will send you a tracking code for the courier once your order has been dispatched which can be used to track the progress of your order. However, if your parcel has not been delivered in the agreed timeframe, please contact us.

Unless agreed otherwise, goods will not be delivered until payment in full has been received in the form of Bank Transfer (BAC) or via a debit or credit card payment through our website or over the phone.

We shall not be liable to pay any compensation to you, other than any refunds which qualify under the Refunds section of these T&Cs. For our Direct Trade services it is the customers responsibility to ensure that an adult over the age of 18 is at the delivery address to sign for receipt of the goods. If delivery cannot be completed you may be liable for any additional courier costs to allow completion.

Defective Products

It is our policy to ensure that all our goods are supplied to our customers in perfect condition. We will only exchange or refund products which we deem “not fit for consumption”. If the product is simply not liked by the customer, it cannot be exchanged, replaced or returned.

It is the responsibility of the customer to report goods damaged in transit.

We shall not be liable to pay any compensation to you, other than any refund mentioned below under Refunds, if applicable. In particular, but without limitation, we shall not be liable to you for loss of profit, damage to goodwill, or any indirect or consequential loss or damage arising out of any damage, defect, negligence or other failing on our part.

No compensation can be offered for loss of wages or revenue due to defective products.

Customers accept responsibility for the safe storage and use of the products upon receipt. Stubborn Mule Brewery are not liable for damage caused by customer mishandling.

You may reject any Products delivered to you that do not comply with an Order placed, provided that you:

i) examine the Products at delivery;

ii) retain packaging materials for inspection;

iii) endorse the relevant delivery note with details of the defect;

iv) notify us in writing of the defect within 3 business days of delivery or, if later, within 3 business days of the defect becoming apparent; and

v) if requested to do so by us, return the Products to our premises.

We shall not be liable for defective Products in any of the following events:

(a) you make any further use of such Products after giving notice of issue; or

(b) the issue arises because you failed to follow our oral or written instructions as to the storage and use of the Products or (if there are none) good trade practice regarding the same.

If you fail to give notice of rejection in accordance with the above, you shall be deemed to have accepted the Products.

If you reject any Products then we may, at our discretion, either replace the rejected Products or issue a credit note equivalent to their invoiced value. Stubborn Mule Brewery Limited will have no further liability to you in respect of the rejected Products.

We shall not be liable to pay any compensation to you, other than any agreed refunds. In particular, but without limitation, we shall not be liable to you for loss of profit, damage to goodwill, or any indirect or consequential loss or damage arising out of any damage, defect, negligence or other failing on our part.

No compensation can be offered for loss of wages due to failed or late deliveries.

Customers accept responsibility for the safe storage and use of the products upon receipt. Stubborn Mule Brewery Limited are not liable for damage caused by customer mishandling.


Ullage

You may reject draught Products delivered to you that are unfit for sale to the public provided always that:

(a) the recommended settling and venting times (72 hours minimum for cask, 24-48 hours for KeyKeg) are observed;

(b) the recommended temperatures (11oC-13oC for our beers) are maintained during storage of the Product;

(c) the storage/service areas (usually a cellar) are kept clean and free of micro biological contaminants;

(d) less than two gallons has been removed from the Product;

(e) the Product is sealed and retained to be uplifted by us or our agent.

Ullages will be collected by us and an ullage note shall be given to you upon collection. A credit note will then be provided by us to you if the defect is identified in testing by us.

Ullages for bottled Products will be accepted by us only prior to the Best Before Date on the bottled Product. Ancillary Goods means those support items including, but not limited to, returnable casks or kegs, taps and stillage.


Cancellations of orders

We will cancel your order and refund any payment provided cancellation is within 7 days after the receipt of the beers and that the beers are returned in good condition, unopened and sealed as required by the Consumer Protection from Distance Selling Regulations 2000 (as amended).

Refund requests that are deemed valid will be made within 30 days from the date of cancellation.

It is the customer’s responsibility to ensure the goods are correctly repackaged and safely returned.

We can arrange collection, but charges will apply.


Returns

Goods may be returned within 30 days of delivery if you are not satisfied for whatever reason. It is the customer’s responsibility to ensure the goods are correctly repackaged and safely returned to the address below:

Refunds

If you receive your products in a poor condition (e.g. broken bottles or spoiled beers), please inform us immediately calling 07730 515251 or by emailing tapandshop@stubbornmulebrewery.com for website sales or sales@stubbornmulebrewery.com for trade sales.  Following review we will give you a refund on spoiled or damaged bottles only. You may also write a letter to us using the same mailing address stated above.

Refunds will be given to the customer within 30 days after the beers have been delivered.

These terms and conditions do not affect your statutory rights. For further information on such rights speak to your Local Authority Trading Standards Department or Citizen’s Advice Bureau.


 Ancillary Goods

For Private purchases in relation to our Party Keg service a deposit, determined by Stubborn Mule Brewery on confirming your order, will be taken at point of payment for goods & services.

All Ancillary Goods provided by Stubborn Mule Brewery Limited shall, unless specified in writing by us, remain the property of Stubborn Mule Brewery Limited and will be returned in good condition or paid for in full by you.

We shall be entitled to charge you for Ancillary Goods that are not returned or made available for collection following receipt and subsequent use by you. Such payment shall be at current market prices as determined by Stubborn Mule Brewery Limited.

Ancillary Goods shall be returned to Stubborn Mule Brewery Limited by the same method as they are delivered to you.

Where Ancillary Goods are to be collected by us you shall ensure such Ancillary Goods are made available for collection at such times as we shall reasonably request.

Where you are solely responsible for the return of Ancillary Goods, it is your duty to organise and return all Ancillary Goods as agreed with Stubborn Mule Brewery. Such responsibility will be deemed to lie with you unless we have specified otherwise in writing.

Ancillary Goods will not be sent out by you to any third party when bought as party of our private Party Pins service.

Where Ancillary Goods are sent out, for instance by (but not restricted to) distributors, by you to any third party, it is your sole responsibility to ensure that the delivery and return of such Ancillary Goods is recorded. These records shall be made available to us when reasonably requested.

Where the Ancillary Goods are sent out by you to any third party, you are responsible for the uplift of these Ancillary Goods in a timely fashion in accordance with BBPA Technical Circular No. 418: Keg and Cask Supply Chain Best Practice.

You agree to keep any and all property belonging to us, including Products and Ancillary Goods which are situated at your premises or place of use safely secured until the time they are collected by, or returned to Stubborn Mule Brewery.

Upon becoming aware of any breach of clauses we may, at our discretion, request the return of all returnable Ancillary Goods in your possession, after which time the replacement value of the returnable Ancillary Goods will become immediately payable by you.

Any breach such as, but not exclusively, those described above will result in the loss of any aforementioned deposits that may have been taken at the point of sale.


Force Majeure

Stubborn Mule Brewery Limited shall not be liable for the failure to fulfil any terms of any transaction governed by these conditions of sale if fulfilment has been delayed, hindered or prevented by any circumstances whatsoever which is not directly within its control such as, but not exclusively, Act of God, Government regulation or order, fire, theft, flood, strike, riot, insurrection, war, national emergency, power shortage, pandemic, terrorist activity.

Stubborn Mule Brewery Limited are not liable for breach of these conditions for any loss or liability arising from circumstances of force majeure.


Law

These Terms and Conditions shall be subject to and interpreted in accordance with the laws of England. Our failure to enforce a right does not amount to waiver of it.


Age Restrictions

By placing an order with Stubborn Mule Brewery (for any alcoholic drink) you are declaring that you are 18 years of age or over. Alcohol is NOT for sale to people under the age of 18.

These items must be used responsibly and appropriately.

It is the responsibility of the purchaser to ensure that the items are received by persons over the age of 18, particularly when requesting delivery to an address other than your billing address.
